Free courtesy
The Tool Shed is a free courtesy for Stephanie's clients. It isn't conditioned on buying, selling, or referring anyone, and it's offered by Stephanie A. Smith P.A., not by eXp Realty, LLC.
Who can borrow
Invite only. Available to real estate customers of Stephanie A. Smith P.A., brokered by eXp Realty, LLC.
Card on file and itemized notice
To borrow an item, you'll keep a card on file with our secure payment processor. We only charge it if an item is lost, damaged beyond normal wear, or not returned, and never more than the item's repair cost or listed replacement cost, whichever is less. Before any charge, we'll email you an itemized notice and give you 3 days to respond.
Written card authorization
I authorize Stephanie A. Smith P.A. to keep my card on file with its secure payment processor and to charge it only if a borrowed item is lost, damaged beyond normal wear, or not returned, for no more than the item's repair cost or listed replacement cost, whichever is less, after emailing me an itemized notice and giving me 3 days to respond. I have read and agree to the Borrowing Terms.
Pickup, return, and extensions
Pickup is at 10 AM on day 1, and items are due back by 4 PM on day 3. If an item isn't back by 4 PM on day 4 and you haven't arranged an extension with us, we'll treat it as not returned and may charge its listed replacement cost. If you return it in good condition within 7 days after that, we'll refund the charge.
Pickup and return location
Pickup and return are at Stephanie's storage unit. The address is shown after you book. All pickup and return times are Eastern Time.
One client per item
Each item goes to one client at a time.
Cancellations
Cancel anytime before pickup in My Reservations.
Care of borrowed items
Please return borrowed items clean. Items are provided as-is, without warranties. Inspect each item at pickup, and don't use anything that looks damaged or unsafe. Tell us right away if it is.
Release, Hold Harmless and Indemnity
Release, hold harmless and indemnity. I understand that using tools and equipment carries risks of serious injury, death, and property damage, and I voluntarily assume all of those risks. To the fullest extent allowed by Florida law, I release, waive, and agree to hold harmless Stephanie A. Smith P.A., eXp Realty, LLC, and their owners, agents, and employees (the "Released Parties") from any claim, loss, or liability for injury, death, or property damage arising from my borrowing, transport, storage, or use of a borrowed item, INCLUDING CLAIMS CAUSED BY THE NEGLIGENCE OF THE RELEASED PARTIES. I will defend and indemnify the Released Parties against any claim by anyone else, including members of my household, guests, and contractors, arising from my borrowing, transport, storage, or use of a borrowed item, INCLUDING CLAIMS CAUSED BY THE RELEASED PARTIES' NEGLIGENCE. This release does not cover gross negligence or intentional misconduct. If any part of it is unenforceable, the rest still applies. I have read this release, I understand I am giving up legal rights, and I sign it voluntarily.
